Summary/Abstract: The production of video, audio or video-audio recordings is classified as information and technical means that represent a group of modern, valuable and offensive institutes, that interfere with basic human rights and freedoms, but without the use of which it is rather demanding, inefficient, or even impossible to detect and prove sophisticated as well as latent crime. The legislator defined the legal conditions regarding their use in the basic code of criminal procedural law. However, a private recording does not always have a clear legal basis, based on which it could be consider a legal evidence and therefore could be admissible in criminal proceedings, which altogether represents frequently discussed topic in the community of professionals in this field.
