Summary/Abstract: The main purpose of this article is to discuss the consequences of changes made to the premises of the aggravated penalty by the amendment to the Criminal Code of February 20, 2015. The main part of the analysis consists of critical remarks to the Supreme Court’s opinion in the above-mentioned matter. The article includes historical, systemic, and functional arguments in favor of the position according to which the concurrence of penalties is not a premise of the aggravated penalty.
