Summary/Abstract: The recusal is a guarantee of the right to an independent and impartial tribunal for every person, but sometimes it is seen as a way to delay court proceedings, to exempt from hearing cases, as an opportunity to “select” a panel. It is necessary to provide an opportunity for an objective view of the request for recusal or of the recusals in general by examining them by another judge.
