About the scope of the principle of non-discrimination

Summary/Abstract: This article aims to examine anti-discrimination provisions in three different systems: on one hand, it includes a historic perspective about the European Convention for the Protection of Human Rights andFundamental Freedoms, it presents the evolution of legislation from ensuring protection against discrimination only in relation to the exercise of another right guaranteed by the Convention, to expanding the protection with regard to every right that a member state of the Council of Europe has granted to its citizens; on the other hand, the article presents the evolution of legislation in matters of discrimination in the European Union by identifying the relevant provisions in the Treaty on the Functioning of the EU, the Charter of Fundamental Rights of the EU, and the European directives on different grounds of discrimination; at last, the article presents national legislation with regard to the matters of discrimination.
