Summary/Abstract: The subject of the article are considerations focusing on the premises of the court's assessment of the dispute in terms of the legitimacy of referring parties to mediation, in combination with procedural instruments specifying the directive of the court's action to resolve the dispute amicably. The considerations are based on the regulations contained in the provisions of the Code of Civil Procedure, taking into account European experience resulting from pilot programs in the field of mediation, conducted in the courts of selected countries in Europe. In addition, the effects of the “Mediation meets judges” project were presented in the form of a questionnaire that can help the court decide on referring parties to mediation.
