Summary/Abstract: The subject of the gloss are considerations referring to the thesis formulated in the justification of the judgment of the Court of Appeal in Katowice of 23 September 2016, I ACa 404/16, in which the court accepted that the difference between a settlement concluded before a court and a settlement agreed before a mediator and approved by a court is that only a settlement concluded before a court has the power equal to acts notarized. Doubts refer to the thesis in the part in which it states the settlement concluded before the mediator, which was “approved by the court”.
