Summary/Abstract: The article analyzes the contradictory case law in the field of the Legal Protection against unlawful dismissal. Series of interpretive case law rules of the Supreme Civil Court are being examined in terms of unification of the practice regarding scope, parties and implementation timelines of the legal protection against unlawful dismissal. A conclusion is made that there is an observed increased trend of disputed decisions which hinders the enforcement of the legislation.
