Summary/Abstract: The article analyzes the possible hypotheses of ascertainment of contributory service. In those cases where data are present, the contributory service can be ascertained either from the official certification documents - available and duly filled out ones - or from the registers maintained by the state bodies, the data contained in the said documents and registers being based on the data submitted by the persons in accordance with the official procedure. A review is made of the ever wider application of those data which are required, processed and kept in the registers and the systems of the National Revenue Agency (NRA) and the National Social Security Institute (NSSI). This method of ascertainment of contributory service is designated as a secondary one because it neither gives expression of the will of the officials regarding any facts that have occurred before them, nor makes any conclusion regarding the facts on the basis of certification documents. Their source is what the respective subjects have declared; therefore, they can differ from reality. The method under consideration does not have material evidential effect within the meaning of Art. 179 of the Civil Procedure Code (CPC), such effect being possessed by the record of service, and the information contained in the respective registers is not binding and can be challenged on the grounds of the direct sources shown in the data.
