Summary/Abstract: The article treats the influence of the origination of unforeseen and unavoidable events on the legal relationship between the tour operator and the consumer under the package travel contract. The analysis considers the possibility of the tour operator to cancel unilaterally the trip before its start, in the event of force majeure, in which case he/she does not owe compensation to the consumer. Special attention is paid to the issue of unforeseen and unpreventable events from the travel consumer’s point of view in particular. Suggestions de lege ferenda are made, to give the customer the possibility to withdrawal from the travel when unforeseen and unpreventable events occurring could endanger his/her personal security, make the provision of the services included in the package travel impossible, or worsen significantly the quality of these services. The article considers also the consumer’s option of a unilateral withdrawal from the travel by reason of an incident of unforeseen circumstances that could significantly impede his/her participation in the travel or make it unacceptable.
