The Sowing and Growing of Narcotic Plants as a Crime under the Criminal Code

Summary/Abstract: The sowing and growing of narcotic drugs are activities incriminated as a crime against public health, which is part of the generally dangerous crimes’ system under Chapter XI of the Criminal Code’s Special Part. The article addresses the development of the criminal and non-criminal legislation related to the realization of these activities. The corpus delicti of the studied crime is explored as well as its correspondence to the regulation under the law of the European Union and international law. An analysis of the relevant case law on the application of Article 354c, paragraphs 1 and 5, is also provided.
