Summary/Abstract: In our country, the principle of finding the truth aims to the judicial bodies to do everything possible to obtain the truth, and the principle of legality contradicts the way, the criteria for establishing guilt and applying the punishment, these are not established by law. In this study I will deepen the aspects related to the guilt recognition agreement, which I will deal with further. This procedure is modeled on Anglo-Saxon legislation, but its application leaves room for interpretation. In analyzing the content of this procedure, I will try to reveal a few inconsistencies that are present in this procedure, wrongly taken over and hurried by our legislator.
