Withholding the payment of a bonus after the termination of collective bargaining agreement

Summary/Abstract: The critical commentary refers to the whole of deliberations of the Court relevant to the determination of the case with the exclusion of the issue of admissible cassation grounds that prevent from analysis and verification of the facts of the case established by the second-instance court. The issues under consideration are based on the relationships between the introduction of the collective bargaining agreement and subsequent suspension of the employees’ rights following from the agreement, having taken into account the rule of legal automatism.
