Summary/Abstract: Article 225A in the European Community Treaty and article 140B in the Treaty of the European Atomic Energy Community confer to the European Union Council the possibility to establish jurisdictional chambers capable of pronouncing first instance decisions on categories of appeals submitted in specific fields. Implementing these provisions of the Treaties, the Council decided under its Decision 2004/752/CE, Euratom of 2 November 2004, which modifies the Protocol on the Status of the European Communities Court of Justice, to establish the European Union Civil Service Tribunal. The European Union Civil Service Tribunal, which shall function beside the European Communities First Instance Tribunal, is competent to rule at first instance on the litigations between the Communities and their agents, in conformity with the provisions of art. 236 in the EC Treaty and art. 152 EAEC Treaty, including the litigations between any body or organism and its staff, where the competence lies at present with the European Communities Court of Justice. The European Union Civil Service Tribunal shall be made up of 7 judges, one of which shall be elected President. They shall have a 6 years' mandate that may be renewed. The judges shall be appointed by the Council, which shall make a unanimous decision in this respect, after having previously consulted a Committee made up of seven personalities elected from among the senior members of the Court of Justice and the First Instance Tribunal and from among jurists with acknowledged competence. This Committee shall endorse the nominations for the positions of judges. At present, the Council has addressed a public appeal for nominations for the seven judges. The deadline for the nominations is 15 April 2005.
