Illegal obtaining of funds. Pre-existing elements and constituent content

Summary/Abstract: The paper aims to examine the pre-existing elements and the constitutive content of the crime of illegal obtaining of funds. Although the crime that is the object of the examination was not provided in the previous Criminal Code, it cannot be said that the incrimination did not exist in the Romanian law, because in Law no. 78/2000 for the prevention and discovery of corruption, at art. It also provided for a criminal act with a similar legal content, without having a marginal title. The paper is part of a criminal law course to be published in the future at a recognized publishing house in the country. Presenting a brief analysis of the constitutive content of this crime, the paper can be useful to the students of the profile faculties, as well as to the practitioners in the field.
