Summary/Abstract: The word referendum or plebiscite is used to denote the process by which a country's citizens are directly consulted vis-a-vis a legal text of particular importance or a situation of national importance. An analysis of the referendum as constitutional institution is achieved by defining and explaining its special functions, namely, the legitimating function, the counter power function, the arbitrage function, and the vote-of-confidence function (confirmatory function).
