CONSIDERATIONS REGARDING THE PSYCHOLOGY OF LISTENING TO THE SUSPECT OR DEFENDANT

Summary/Abstract: The suspect's or defendant's hearing procedure is insufficiently put to use regarding its potential in finding the truth, shortening the trial period and reducing judicial spendings. The New Criminal Procedure Code brings additional guarantees protecting the rights of the suspect or defendant during the judicial trial thus increasing the role of investigation officers, especially before the hearing, when the evidence is gathered. The purpose of the article is to identify the psychological aspects that can lead to a confession during the investigation, aspects that fall under the legal provisions of the Criminal Procedure Code.
