Summary/Abstract: The paper concerns the controversial issue of criminal liability for refusal of service that is stated in Article 138 of the Polish Code of Contraventions. Presented problem constitutes an interesting case of diffusion of constitutional axiology and conflicts of values to the ground of criminal law. The author answers the question how such conflicts should be resolved in a democratic state.
