Summary/Abstract: The market of gambling in Romania is growing due to the global crisis that began in 2008. The setting to of the National Office for Gambling in 2013 represents an important step taken by the national authorities in order to manage effectively the specific issues. This article tackles the issues regarding the monopoly in gambling and a practical situation on Romania's infringement in the field where the majority of the Member Sates have problems due to the national provisions. The legal provisions on online gambling represent for the European Commission a challenge and the need to identify some measures to solve the problems. But this would be difficult in the near future because of the particular aspects and the way in which Member States accept or not to have traditional or online gambling.
