Summary/Abstract: In this article, authors focus on the comparison of the term „damage“ in terms of fixed amounts of damage, as well as in terms of its use and impact on the level of impending custodial penalties. At the same time, leniency of the general provision Section 125 (1) of Act No. 300/2005 Coll. Criminal Code (in comparison with Section 138 (1) Act No. 40/2009 Coll. Criminal Code) is stated in contrast to excessive repression manifested in a Special part of Act no. 300/2005 Coll. Criminal Code. Simultaneously, authors find several conclusions, many of that represent an idea for better criminal law adjustments of Act No. 300/2005 Coll. Criminal Code, also in terms of deeper respect of the principle ultima ratio in normative activity of criminal law.
