Summary/Abstract: The implementation of transitional justice institutions is a complicated process, but nevertheless dynamic, conditioned by various factors, including political, legal, historical, religious, etc. Thus, this process cannot be a uniform one, and this fact inevitably conditions the effects that are produced in relations with the respective society. Traditionally, experts in the field are divided into two groups — adepts of judicial prosecution and supporters of amnesty processes in the forms existing in the context of transitional justice. This is also beneficial for the Republic of Moldova. There are two sensitive moments that require the transitional justice concept — the unresolved “Transnistrian” conflict and the society divided for political criteria.
