Summary/Abstract: The article describes the evolution of the need and usefulness of the commercial law, under the terms of the dualist system and of the monist system of regulating the private law relationships. Furthermore, the need and usefulness of a new Commercial Code is presented, under the terms of the unitary monist system, enshrined by the applicable Civil Code.
