Summary/Abstract: In the judgment of 12 April 2016, court file No. II PK 73/15, the Supreme Court took the view that a non-compete clause concluded with a legal adviser acting as an employee is invalid due to the lack of causa in such an agreement. This article presents a critical analysis of the aforementioned view whilst searching for other possible grounds for the invalidity of these type of agreements, in particular in the context of the principles of social coexistence and diligent performance of a profession of public trust.
