VERIFICATION BY THE INSURANCE AUTHORITY OF THE EMPLOYEE’S SOCIAL INSURANCE TITLE, ASSESSED FROM THE PERSPECTIVE OF THE INSURED PERSON’S PREGNANCY

Summary/Abstract: The presented text concerns the verification of the reported title to social insurance from theperspective of the insured person’s pregnancy. It develops the thesis established in case law thatpregnancy does not exclude the insured person from taking up employment, even if it is associatedwith the probable occurrence of social risk and constitutes an instrumental action of the insuredperson aimed at obtaining social security. The author notes that the difficulty in verifying the title ofinsurance is not related to the interpretation of the law, but to the factual findings assessed throughthe prism of the stereotype of generalization.
