Summary/Abstract: One person has been driving a car during a year without possessing a driving licence, so how many offences has he committed? Only one, but under a continuing form, thus a natural unit of crime. The existence of the continuing offence derives not only from the need to complete the image of the offender’s operation, but also from the legislator’s intention to create a mechanism that will fairly punish a certain kind of criminal behaviour. This type of offence has shown particular stability over time, but it cannot be ignored the way it interacts with the new social realities, the decisions of the Constitutional Court and the other norms.
