The Evolution of the Waiver to the Criminal Proceedings in the New Criminal Procedure Code

Summary/Abstract: The New Criminal Procedure Code has brought very many changes in the Romanian legislation, upon its entry into force, among which also the institution of the waver to criminal proceedings. Immediately after the New Criminal Procedure Code became effective, has occurred the problem related to the dynamics of the amendments made to the later, as a result, among other, of the declaration of certain procedural criminal provisions as non constitutional . Among the institutions affected by the amendments made to the New Criminal Procedure Code is also the one of the waiver to the criminal proceedings, regulated by Art. 318, the analysis of which will make the scope of the hereby article.
