Brief considerations regarding the application of the principle Ne bis in idem

Summary/Abstract: According to the NCPP, the general principle of ne bis in idem law is one of the fundamental principles of the criminal process.The national courts, as well as the CJEU, have illustrated in the decisions that this principle has pronounced, along with other aspects concerning the character of the solutions pronounced by the prosecutor, the (non) definitive character of the solutions pronounced by the courts, the crime contest, reporting directly to the existing factual situation.
