About the replacement of the prison sentence with the fine in the case of art. 6 paragraph (3) Criminal Code

Summary/Abstract: The institution of applying the more favorable criminal law after the final judgment of the case was subjected to several changes in the new Criminal Code, by which, first of all, the problems previously mentioned in the specialized practice were removed.However, other issues are the subject of discussions in the legal doctrine, one of which concerns how to replace the prison sentence with the fine, in the case of art. 6 paragraph (3) Penal code, on which several opinions are expressed and to which we present in this article arguments in favor of one of them.
