Summary/Abstract: The legislator avoided one of the causes removing criminal liability – absence of preliminary complaint – every time it amended the old Criminal Code. Now we can take note of a single intervention thereon, through Law no. 6/1973. Discussions in judicial doctrine and practice concerning this cause and the acceptance of criminal liability of a legal entity are only some of the reasons that determined the legislator to regulate differently the absence of preliminary complaint in the new Criminal Code. The legislator’s interventions are the subject of the art. entitled “Additions of the New Criminal Code to the Institution of Absence of Preliminary Complaint”, where they are identified and analyzed in both parts of the Criminal Code, along with a brief legislative history of the cause.
