Summary/Abstract: Contemporary criminal law systems share the same orientation of criminal policy which recognizes the need for a special sanction regime for delinquent juveniles, because of their personality, characterized by insufficient training and bio-physical developing which is reflected in taking and enforcement of the decision to commit unlawful action. Following these trends, changes in Law no. 286/2009 on the Criminal Code, and pursued by the complete abandonment of punishment for delinquent juveniles and establishment of a system of penalties based only on educational measures, including of course both non – custodial educational measures and custodial educational measures.
