Summary/Abstract: The existence of an enforceable title is a sine qua non for the start of execution. Regardless of how enforcement is to be made, the obligation is sought to be enforced must be constantly enforced by a writ of execution. The phrase "under an enforcement only" used by the legislator in art.632 NCPC is also likely to underscore the limited scope of the acts under which enforcement can be achieved, in the sense that only enforceable execution may lead to initiation, the exclusion of any other securities that do not have this character. However, in the event that the execution started under a title that is not law enforcement, it can get abolishing acts of enforcement by the enforcement appeal.
