The administrative liability of the person managing the domestic insurance entity in the light of the latest amendments to the act on competition and consumer protection

Summary/Abstract: Niniejszy artykuł koncentruje się na przedstawieniu ogólnej problematyki charakteru odpowiedzialności administracyjnej ad personam, a także na szczegółowej analizie zarówno zakresu podmiotowego i przedmiotowego, jak i przesłanek odpowiedzialności administracyjnej osoby zarządzającej krajowym zakładem ubezpieczeń, ukształtowanej na podstawie art. 106b ustawy z dnia 16 lutego 2007 r. o ochronie konkurencji i konsumentów, który wszedł w życie z dniem 15 grudnia 2018 r. na mocy postanowień art. 11 pkt 1 ustawy z dnia 9 listopada 2018 r. o zmianie niektórych ustaw w związku ze wzmocnieniem nadzoru nad rynkiem finansowym oraz ochrony inwestorów na tym rynku. Analizę powyższych zagadnień wieńczą konkluzje odnośnie do konstytucyjności tej regulacji. This paper focuses on the analysis of the provision of Art. 106b of the Act of February 16, 2007 on Competition and Consumer Protection, which entered into force on December 15, 2018, pursuant to the provisions of Art. 11 point 1 of the Act of 9 November 2018 on amending certain acts in connection with the strengthening of supervision over the financial market and protection of investors on this market. The article discusses the issues related to the general nature of the administrative liability, as well as a detailed analysis of the subjective and objective scope and administrative liability premises of the person managing the domestic insurance entity, based on the new Art. 106b. The above analysis ends with the conclusions regarding the constitutionality of this new regulation.
