Summary/Abstract: This article is devoted to a legal analysis and assessment of the proposed Position Paper of the European Insurance and Occupational Pensions Authority on differentiated pricing practices in non-life insurance, submitted for consultation in July 2022. Although formally the Position Paper is a non-normative and non-binding piece of soft law, in practice the expectations outlined in it for Member States and nation- al insurance supervisors seem to go beyond what is acceptable regulation by soft law instruments.
