Summary/Abstract: The article presents the legal difficulties associated with civil liability insurances. Legal ralations (which result from insurance contract) haven’t been yet properly explained by commentators and judicature. This matter seems to be far more understandable by making a distinction into debt and liability that reduces this issue to 2 theories. Author presents advantages and disadvantages that come along with mentioned theories. Author also presents mentioned distinction basing on similar law institutions and as result of that Author presents conclusions that comply with civil law systemwide approach. This matter is in particular important because it allows better understanding of insurers accessory liability.
