Summary/Abstract: Even though this phenomenon is known since ancient times, drug abuse or addiction, only in modern times it has been characterized as social danger through criminal activity of individuals or groups which often gets a character of organized crime. Therefore, based on relevant international standards adopted within the framework of United Nations, all modern legislations provide for several forms and ways of abuse of narcotics as criminal offences. Severe penalties, as well as other kinds of criminal sanctions, are prescribed for their perpetrators, in the first place specific security measures of medical character. This paper analyzes the concept, elements and characteristics of criminal offences of abuse of narcotics in positive criminal law of the Republic of Serbia, on the basis of legal solutions, legal theory and court case law.
