Disposal of real estate in the course of the execution and its consequences in the field of real estate management

Summary/Abstract: The subject of this study is the analysis of selected issues concerning the management of the real estate occupied during the enforcement proceedings. Particular attention is paid here to the issue of the sale of real estate during the enforcement proceedings and its effects in the area of management. The author drew attention to some interpretation doubts regarding some of the provisions regulating this matter. She also pointed to problems that may arise in a situation where after the sale of the property during the execution, the buyer becomes a debtor against whom enforcement proceedings are conducted in relation to this property. Due to the fact that the regulations concerning the management of the occupied property do not clearly specify who should manage the real estate in such a situation, the author has attempted to analyze this issue and indicated in its opinion the most rational way of interpreting these provisions, however, indicating the need for further clarification by the legislator.
