Summary/Abstract: The period of occupation in Albania, April 1939 - November 1944, includes two phases which correspond to the rule of the two respective aggressor powers which realized its military occupation. The first phase, April 1939 - September 1943, is the period of the Italian fascist occupation and rule. Whereas after the capitulation of the fascist Italy, 8 November 1943, the place of the Italian occupiers is occupied by the Hitlerian Germany. In the public opinion, but also in the circle of the historians, has had contradictory thoughts as regards the essence and the nature of the occupation in these two periods. The debates reduced mainly on a problem: whether there was continuity of the state of occupation in its phases, with all the peculiarities, features and consequences which brings about it for an occupied country, or, between them, has been distinctions, even substantial ones, which have done that in one phase, in that of the German occupation, the Albanians have enjoyed another status, which differs essentially from that of the Italian occupation.
