Summary/Abstract: The focus of this study is the shared custody as a way of joint exercise of parental rights in parallel by both parents in the light of Court Decision No. 1 / Case 1/2016 of the Civil Collegy of the Supreme Court of Cassation. Particular attention has been paid to the possibility of achieving it through a mediation procedure as well as the individual elements that each agreement should contain, along with the possibility of its enforceability.
