Misselling of financial services as a behavior violating good manners

Summary/Abstract: Misselling (understood as proposing to consumers financial services while violating good manners) is considered by Polish law as an act against consumers’ rights. It shows however also many similarities with some acts of unfair competition and/or unfair commercial practises, which as all refer to good manners as one of their legal circumstances. The article discusses the scope of good manners which should lead entrepreneurs to discover the real needs of the consumers in respect of potential financial services and their obligation to inform customer of all risks connected with the potential service. Regardless of many similarities between different legal acts it is worth noting that the competition authority is able to protect consumers more efficiently when referring to misselling as a separate illegal conduct disobeying good manners, as when pointing to unfair competition or unfair competition practises.
