Summary/Abstract: An agency agreement represents the highest form of an intermediation contract. Concerning the legal regim, legal provisions of the agency agreement may come into conflict with competition law rule, aspect which was not considered by the legislator. Such matters are caused by maladjustment of the European directives when applied to national law, which may in turn cause the birth of contradictory rule, sometimes foreign to romanian law principles.
