Summary/Abstract: In the public procurement contracts FIDIC-Red Book, the entrepreneur is under no legal obligation in regard to the design work. This activity is the strict obligation of the Contracting Authority and the designer, in the context in which a procurement procedure is carried out to prepare the project. The inclusion in the contract of contract terms for the execution of the works of certain contract terms which lay down obligations on the contractor in respect to the design activity is classed as fraud.
