Summary/Abstract: Our work addresses an area of recurrent epistemic identifications necessary for constitution and constitutionalism as postmodern forms of evolution of societies structured in an international context. As we know, the constitutional consciousness of society is objectively determined to derive and generate legal doctrines from ancient times to the present, the ideas of classics in the field of legal regulator of society (passim). The axiological and praxiological prerequisites of a constitution writing reside in the profile of society, state, law, politics and morality. The current trend is that the practice of judicial review of legislation should be dropped in constitutional bills of rights and political decisions left to people and elected and accountable representatives.
