Summary/Abstract: The article is examining the conception “freedom of contract”. On the base of the development of the legal theory and court practice are analyzed legal nature of the freedom of contract as a civil and trade law principle. Also are examined the limitations of that freedom, which are provided in current litigation, as well as some peculiarities of these limitations.
