Summary/Abstract: The article focuses on the detention of unaccompanied migrant children. It refers to regulation in international law, Council of Europe, namely European Convention on Huma Rights, and EU law. Primarily the article focuses on the analysis of the most recent case-law of the European Court of Human Rights on the detention of migrant children and the evaluation thereof. The article thoroughly analyses especially the judgment of European Court of Human Rights in case Abdullahi Elmi a Aweys Abubakar proti Maltě. The outcomes of this decision are interpreted in the context of other relevant case-law of this court.
