RIGHTS OF PERFORMING ARTISTS

Summary/Abstract: Under the term of artists-performers we mean persons and artisic ensembles (groups) that perform, recite, declaim, sing, play, dance in artistic way or perform in some other way literary, musical, theatrical and the other works of art. Problem of the artists-performers rights pretection has been of recent origin and it dates from appearance of the tehnical devices for recording, broadcasting, repro-duction of literary, musical and the other types of authors works. Without taking.into account how the material of performers rights is fixed and whether creations of the artists-performers belong to copyrihgl in the traditional sense or, to rights "related", that is "next to" copyright, national legisations recognizes certain moral and property rights to artists-performrs on the ground of their inter-pretations. Since the question of contents and importance of the material of performers right passes national borders, the material of performers rights has been regulated on the international plan as well, by pronouncing The International Convention on protec¬tion of artists-performers, phonogram manufacturs and radiodiffusion institutions, in Rome (Rome Convention) in the year 1961.
