Summary/Abstract: The obligation to inform the counterparty during the negotiation process results from the application of the principle requiring the negotiation to take place in good faith, but also from the mechanisms pertaining to the consent that may be affected by dolus malus. The obligation to inform is different in content in the preliminary stage of the agreement to the obligation to inform in the performance of various contracts.
