Summary/Abstract: The circumstance that the ship crew had not maintained the permanent guard duty in the engine room before the ship sank has been characterized as negligence of the crew in relation to the operation of the ship. In accordance with the rules for insurance of sea-going ships, negligence of the crew constitutes an insured risk, so this circumstance does not exclude the liability of the insurer.
