Summary/Abstract: Should provisions of Article 201 and 202, Paragraph 1, Point 3 of the Maritime Code apply, the owner of a boat may require that the boat be entered in the register of ships, no matter whether the boat meets or not the requirements referred to in Article 5, Paragraph 1, Point 2) of the Maritime Code. The circumstance that the boat was entered in the register of ships has no impact on the subject matter jurisdiction. The proceedings upon a proposal for order of enforcement on a boat fall within the competence of the Municipal Court.
