Instytucye Gaja by Teodor Dydyński: The First Polish Translation of the Gaius’ Institutions

Summary/Abstract: The aim of this paper is to discuss the first translation of the Gaius’ Institutions into Polish. Its author, Teodor Dydyński, lecturer in Roman law at the Warsaw Major School in 1866-1909, limited himself to translating the first two books of the work, but laid the foundations for later translations (in 1982 and 2003). The method of translation has been discussed (including the review of the translation of book one by F. Zoll from 1865); the translators of the sources of Roman law are faced with the choice of whether to leave specialist legal terms in the original (or the polonised) version, or give them—as much as possible—entirely in Polish, through neologisms or in a descriptive manner. The method adopted by the author was also evaluated, also in terms of the precision of the translation of individual terms and formulations.
