Summary/Abstract: In this paper we have dealt with the definition and examination of certain aspects concerning the driving offense on the public roads of a vehicle without a driving license. We have also proceeded to the comparative examination in the light of the envisaged amendments, with some considerations on the application of more favorable criminal law. Last but not least, we have formulated some critical opinions, and we made a few de lege ferenda proposals, which involves completing the text or eliminating some notions. The novelty brought by this paper is reflected in the conducted examination, as well as in the de lege ferenda proposals. The work may be useful to both the legislator who is supposed to operate the suggested changes, and for the academic environment and practitioners in the field.
