Summary/Abstract: The aim of this article is the adjudication of the institution of incapacitation through the prism of its correspondence with the fundamental rights and liberties that are guaranteed in the Constitution of Poland. The autor focuses on discussing some of constitutional standards relating to the institution of incapacitation based on the selected case-law of the Constitutional Tribunal.
